​Terms & Conditions

These Terms & Conditions (“Terms”) govern all services provided by Merrick Cousley Photography (“we,” “us,” or “our”). By booking, paying a deposit, or using our website, you agree to these Terms.

 

 

1. Booking, Payments & General Policies

​

1.1 Deposit / Retainer

 

A non-refundable retainer is required to secure your date for all photography services.

 

1.2 Final Payment

 

  • Weddings: Due 14 days before the wedding date.

  • Corporate/Commercial: Due on delivery, unless written credit terms are approved.

  • Portrait Sessions: Due on or before the shoot day.

 

1.3 Accepted Payment Methods

 

  • Credit/debit card

  • Bank transfer

  • Cash

  • Secure online payment links

 

Late payments may delay delivery of images.

​

1.4 Rescheduling

 

Clients may reschedule once without penalty, subject to availability.

​

1.5 Cancellations

 

All retainers are non-refundable.

Cancellations made less than:

 

  • 30 days before weddings

  • 72 hours before corporate shoots

  • 48 hours before portrait sessions

    may incur additional fees depending on commitments already made.

 

 

2. Creative Control, Conduct & Limitations

 

 

2.1 Photographer Discretion

 

By booking us, you acknowledge our:

 

  • Artistic style

  • Editing approach

  • Creative decision-making

 

Specific shots are not guaranteed.

2.2 Client Cooperation

 

Clients must ensure:

 

  • Punctuality

  • Access to locations

  • Cooperation from participants

  • Accurate schedules and instructions

​

2.3 Guest & Environmental Interference

 

We are not responsible for images affected by:

 

  • Guests blocking shots

  • Venue restrictions

  • Weather conditions

  • Poor lighting conditions

  • Videographers or wedding guests interfering

 

2.4 Equipment Failure

 

In the unlikely event of equipment failure, loss of images, or unforeseen circumstances beyond our control, our liability is limited to the amount paid by the client.

 

 

3. Delivery of Images

​

3.1 Turnaround Times

 

  • Weddings: 4–10 weeks

  • Corporate/Commercial: 3–14 days (depending on scope)

  • Portrait Sessions: 1–3 weeks

 

Rush delivery is available for an additional fee.

​

3.2 Delivery Method

 

Images are delivered via a secure online gallery unless otherwise arranged.

​

3.3 Gallery Availability

 

Galleries remain active for at least 90 days.

Clients are responsible for downloading and backing up their images.

​

3.4 RAW Files

 

Raw, unedited image files are not provided under any circumstances.


4. Editing, Retouching & Revisions

​

4.1 Included Editing

 

All packages include:

 

  • Basic color correction

  • Exposure adjustments

  • Cropping

  • Light retouching

 

4.2 Advanced Editing

 

Requests such as:

 

  • Body reshaping

  • Detailed skin retouching

  • Object removal

  • Background replacement

    may incur additional fees.

4.3 Revisions

 

Reasonable revisions are allowed within the scope of the package.

Extensive revisions may incur additional costs.

 

 

5. Copyright, Licensing & Usage Rights

​

5.1 Photographer Rights

 

We retain full copyright to all images captured.

​

5.2 Portfolio Use

 

We may use images for:

 

  • Portfolio

  • Website

  • Social media

  • Marketing materials

 

Clients may request otherwise in writing.

 

5.3 Client Usage

 

  • Weddings & Portraits: Personal use license only.

  • Corporate/Commercial: Commercial usage rights depend on the package selected.

    Extended licensing (billboards, major ads, national/international campaigns) may require additional fees.

5.4 Prohibited Use

 

Clients may not:

 

  • Resell images

  • Apply heavy filters that distort the photographer’s style

  • Claim the images as their own work

6. Service-Specific Terms

 

6A. Wedding Photography Terms

​

6A.1 Timeline & Coordination

 

Couples must provide:

 

  • Final timeline

  • Venue details

  • Planner/coordinator contact information

  • Shot list (if desired)

 

Any updates should be shared 72 hours in advance.

​

6A.2 Venue Access

 

Clients must secure access and any required permits.

​

6A.3 Missed Moments

 

We aim to capture every key moment but cannot guarantee specific shots due to:

 

  • Time constraints

  • Venue rules

  • Guest interference

  • Delays

​

6A.4 Meals

 

For weddings lasting over 5 hours, a meal must be provided to the photographer.

 

 

6B. Corporate & Commercial Photography Terms

​

6B.1 Licensing

 

Corporate images may include:

 

  • Web usage

  • Print materials

  • Social media

  • Advertising campaigns

  • Editorial use

 

Licensing level will be clearly stated in the invoice or agreement.

​

6B.2 Revisions

 

Basic retouching is included.

Additional revisions or specialized edits are billed per image.

​

6B.3 NDAs & Confidentiality

 

We respect all NDAs and corporate privacy policies.

​

6B.4 Props, Production & Staffing

 

Any required:

​

  • Props

  • Sets

  • Additional lighting

  • Assistants


Will be added to the quote and approved in advance.

 

 

6C. Portrait Photography Terms

​

6C.1 Late Arrivals

 

Late arrivals reduce shooting time.

Arrivals over 20 minutes late may require rescheduling or a shortened session.

​

6C.2 Outfits & Styling

 

Clients are responsible for:

 

  • Outfits

  • Makeup

  • Props

  • Personal items

​

6C.3 Image Quantity

 

Final image count is based on the scope of work, length of session

We charge for time, creativity, and extensive years of experience

 

 

7. Privacy & Data Protection

 

All personal data is handled according to our Privacy Policy, located on our website.

 

 

8. Governing Law

 

These Terms are governed by the laws of Jamaica.

9. Acceptance

 

By booking or using our services, you confirm that you have read and agree to these Terms & Conditions.
